Huawei CFO’s Lawyers Refute U.S. Claims with HSBC Document

Huawei chief financial officer Meng Wanzhou’s lawyers claim that HSBC’s internal documents contradict U.S. claims that could result in extradition from Canada.

HSBC’s own records reflected Huawei’s continued control over dealings with Iran-linked Skycom, Meng Wanzhou’s lawyers told a British Columbia court, including control over its accounts held at the British lender.

According to Meng’s lawyer Mark Sandler, HSBC had conducted risk assessments with full knowledge of Huawei’s relationship with Skycom, adding that the latter’s financial statements were even included in a report on the Huawei account to the bank’s head office.

We’re now in a different universe, Sandler said at the hearing yesterday. There is no plausible case for committal.

Meng is approaching the final round of extradition hearings scheduled for August.

If admitted by the court, the HSBC documents which were obtained in a deal overseen by a Hong Kong court in April will be usable for the hearing.

Acting on behalf of the U.S. in the case, lawyers for the Attorney General of Canada have yet to respond to the submissions.

Huawei CFO Wins Extradition Hearing Delay

An agreement between Huawei and HSBC in Hong Kong has led Canadian courts to delay chief financial officer Meng Wanzhou’s extradition hearing.

Huawei CFO Meng Wanzhou was handed a three-month delay for her U.S. extradition hearing, according to a court ruling, which was scheduled to conclude in May.

Defense attorney Richard Peck had requested «a modest frame of time» to read newly obtained documents and potentially file them as evidence.

Peck and the defense team were referring to a breakthrough agreement made between Meng, Huawei, and HSBC in Hong Kong courts earlier this month for «documents production».

According to a statement from the bank, it agreed to «resolve the legal proceedings in Hong Kong regarding their request for documents».

Defense lawyers claimed that the documents would prove that HSBC was not misled into business dealings with Iran, causing it to break U.S. sanctions.

    UBS Disperses Calming Drops

The world’s largest wealth manager sought to soothe investor nerves amid market turmoil sparked by the coronavirus pandemic.

Swiss-based UBS said it had observed «little to no» disruption in service to wealthy clients as trading volumes surged amid a stock and bond market rout. Worries that the coronavirus pandemic’s effect on the global economy is overshadowing broad policy moves meant to counter the fallout.

The remarks address a pandemic expected to wreak economic havoc: Deutsche Bank on Wednesday predicted a global recession, with the demand to plunge in China this quarter and in Europe and the U.S. next. Rating agency Moody’s noted that global investment banks’ solid liquidity allows them to manage rising drawdown demands.

Private banks like UBS are seeing volume surge as investors shift their portfolios and hunt for liquidity to meet margin calls. We have seen little to no disruptions in service to our clients and have successfully managed very high volumes across our businesses, particularly in our trading operations, finance chief Kirt Gardner said on Wednesday.

He underscored UBS’ conservative capital cushion, its ample liquidity and funding, and successful stress tests. «While previous economic growth projections are clearly no longer valid, it is too early to forecast the impact» – and it depends on official responses from health, monetary, and other authorities, he noted.

    Vicinity Centres names new CFO

Retail landlord Vicinity Centres has appointed Spark Infrastructure executive Nicholas Schiffer as its new chief financial officer.

Schiffer, who will take on the role in September, has been Spark’s CFO since July 2017. He will report toVicinity CEO and managing director Grant Kelley when he joins the property firm’s executive committee.

Kelley said the company was delighted to have secured someone of Schiffer’s calibre, following an extensive domestic and international executive search, to join its team and lead the finance department.

As Vicinity’s CFO, Schiffer’s responsibilities will include leading the finance, investment management, treasury and capital transactions functions, in addition to Vicinity’s wholesale funds and strategic partnerships business.

Kelley said the company’s board and executive team look forward to welcoming Schiffer at a time when the business is rolling out a new strategy of creating a core portfolio of market-leading destinations, realising mixed-use opportunities across the group’s portfolio and expanding its wholesale funds platform.

“Nick’s broad finance, banking and industry advisory experience, together with his background in wholesale funds formation, will be a great complement to, and further strengthen, Vicinity’s executive team capability,” Kelley said.

Schiffer previously served as managing director at Credit Suisse for 17 years with responsibility for investment banking within the energy, transport and general infrastructure sectors across Australia and New Zealand.

Kelley said Schiffer’s knowledge and experience in infrastructure are widely relevant to the property industry and would bring some additional diversity of thought to the leadership team.

“With Nick’s appointment, I am confident that we are building up significant bench-strength in our executive team, which reflects the specialist and diverse capability we have across our organisation,” he said.

Kah Wong, currently Vicinity’s acting CFO, will return to the role of general manager of treasury, when Schiffer joins Vicinity in September.

  • Glossier’s president and CFO quits

    Glossier’s president and CFO quits

One of Glossier’s earliest executives is leaving. Henry Davis, president and chief financial officer, is exiting the direct-to-consumer beauty brand after almost five years to pursue his own entrepreneurial opportunities. This comes weeks after Davis’ position changed from chief operating officer to chief financial officer, a role the company has been trying to fill since former vice president of finance Matthew Weiler departed the company earlier this year.

In addition to Davis and Weiler, former creative director Helen Steed left Glossier a year ago to join New York-based branding and design agency Aruliden as vice president and creative director. Glossier confirmed Davis’ departure. His last day will be December 31.

“Henry has been my partner since the earliest days of Glossier. He was one of the first people to understand the opportunity to build a new kind of company — one that leverages technology to create in collaboration with its customers,” Emily Weiss, founder and chief executive, told BoF. “I’m excited for him as he begins his own entrepreneurial journey.”

After Weiss, Davis was the most public face of the business. He was one of the first executives hired by Weiss and joined the brand in June 2014, three months before launching in October of that year.

Previously, Davis worked at Index Ventures, an early investor in Glossier that also led, along with Institutional Venture Partners, a $52 million Series C round of funding in February.

A changing of the guards in upper management follows a handful of new hires including Marie Suter, who left Condé Nast after a 13-year tenure to join Glossier as creative director in March.

Facebook alum Maykel Loomans is now head of digital product design, and Kym Davis, formerly of Fenty Beauty, is leading product development.

Ashley Mayer, who came from Silicon Valley-based venture firm Social Capital, is head of communications, and former head of communications, Amy Snook, recently became chief of staff.

The company, which has almost 200 employees, has raised $86 million and, according to a source close to the company, is on track to do over $100 million in revenue this year.

In November, Glossier opened a flagship location in New York City that by customer accounts was one of the most bustling stores in the area.

To date, the brand has only sold its range of skincare, cosmetics and body care through direct channels, an anomaly for direct-to-consumer lines that have begun to rely on retail partnerships to scale. Since inception, Weiss’ mission has been to retain complete control of its brand experience by creating a direct retail network to support the digital first line.

And even though this may have resulted in the brand not yet scaling to the size of many other heavily funded startups, Weiss’ — and by extension Glossier’s — influence is outsized. Weiss has stayed true to her direct roots and in doing so has managed to build a cult following and community of engaged consumers willing to buy anything put forth by the brand, from its best-selling Boy Brow grooming pomade to its Milky Jelly Cleanser.

The brand’s most engaged consumers have become ambassadors that are treated like influencers — some unpaid and others receive cash and shopping credits for their efforts in spreading the word.

Weiss has been thoughtful about international expansion. Despite global demand from the onset, she took three years to sell outside the US. Glossier started selling in Canada and the UK last year and this year entered Ireland, Sweden, Denmark and France. The brand now sells across seven countries.

“This team has proven that building a business alongside your customers is the future — not only in the world of beauty, but for all internet-first brands,” Davis said. “I couldn’t be more bullish about Glossier’s future as I embark on founding my own company.”

Nabil Mallick, a partner at Thrive Capital and Glossier board member, will serve as interim CFO. A search for a full-time CFO is underway.
