    Shein Slapped With $176m Fine Over Data Violations, Vows To Appeal

    Internet-based, fast-fashion purveyor Shein has come under fire from France’s data protection authority, resulting in a fine of 150 million euros ($175.61 million USD) for the company’s misuse of cookies. This decision has been contested by Shein, who plans to appeal.

    Violation of Data Protection Laws

    The Commission Nationale de l’Informatique et des Libertés (CNIL), a government entity responsible for ensuring consumer data protection, condemned Shein’s website for its failure to abide by regulations. The issue at hand was the collection of consumer data without their explicit consent.

    During a test conducted in August 2023, the CNIL found that even as users of Shein’s French site opted out of cookies – small files utilized by websites and advertisers to identify individual users and track their online activity – the cookies were still present on the user’s computer.

    According to the European Union’s General Data Protection Regulation, cookies are categorized as personal data due to their ability to identify customers and target them with advertisements. Websites are obligated to secure consent to use these cookies.

    Significant Fine Reflects Multiple Breaches

    The CNIL stressed that the hefty fine was a reflection of Shein’s multiple violations. The company was found to be depositing cookies without user permission, ignoring user choices, and failing to provide adequate information.

    Contributing to the size of the penalty was also Shein’s significant reach, with the CNIL pointing out that 12 million French residents visit the site monthly.

    Shein to Contest Decision

    Shein has pushed back against the CNIL’s actions, voicing their intention to file an appeal. The company described the fine as “wholly disproportionate” considering the nature of the purported issues, their current compliance, and the proactive steps they’ve taken towards correction.

    The company stressed that they’ve been fully cooperative with the CNIL since August 2023, and have bolstered all facets of their data protection procedures.

    Founded in China and headquartered in Singapore, Shein suggested that the fine was political in nature, rather than the result of a fair and balanced enforcement.

    Shein, known for its affordable fashion items, has faced backlash in France, where legislators have supported a proposed law to regulate fast-fashion. If this law is enforced, Shein’s advertising would be prohibited.

    Mondelez falls short in China with Zero-sugar Oreos pitch

    Initial reaction from the launch of Oreo Zero sugar-free cookies in China has been disappointing, Mondelez International Inc’s CEO said, underscoring some of the challenges facing the global snack giant as it makes a big push in the market.

    Mondelez launched Oreo Zero in China in August, taking a cue from social media trends showing reduced-sugar and sugar-free diets as a key trend, and the limited availability of zero-sugar biscuits in the country.

    “The reaction of the consumer has been a little bit disappointing … for one reason or the other, the consumers feel it is not the real thing,” Chairman and Chief Executive Officer Dirk Van de Put told Reuters.

    “This indicates the dilemma,” he said. “We can offer the products to the consumer, but it’s not given that the consumer will buy and eat them.”

    Mondelez, which also makes Ritz crackers, belVita biscuits, Cadbury chocolates and Trident gum, has set a target to grow Oreo sales by $1 billion by the end of 2023. The brand surpassed $3 billion in global sales in 2019.

    Oreo Zero cookies contain maltitol instead of traditional sugars like sucrose and glucose, and the tweak gives a very slight difference in taste that only heavy consumers of regular Oreos would be able to identify, according to the company.

    The lukewarm consumer response underscores a challenge for global snack firms with a well-known brand and product. Mondelez varies the amount of sugar it includes in Oreos in different markets around the world. In China, Oreos have less sugar than do Oreos in the United States, which could make for an easier transition to no-sugar cookies.

    Chinese consumers, however, remain cautious about packaged foods’ no-sugar claims, said Michael Norris, research and strategy manager at Shanghai-based consultancy AgencyChina.

    For example, sugar-free drinks commanded only 1.25% of China’s soft drinks market in 2019, according to a June Dongxing Securities report, though Genki Forest’s sugar-free fizzy drinks and Suntory’s Oolong tea are gaining popularity.

    Hong Kong stylist Hilary Tsui has opened a cafe connected to her fashion boutique designed to “transport guests to a new planet”.

    The store – Her in Causeway Bay – serves coffee, cookies and ice-blended coffees to browsing customers, marrying Tsui’s passion for fashion and gastronomy. It was designed by studio Clap, based in Valencia, Spain.

    According to design news site Dezeen, the retail space features stacked terracotta display plinths and celestial aluminium partitions help create “an other-worldly atmosphere”.

    “Tsui’s desire was to create a retail space dedicated to contemporary women that brings together her two passions in one place: fashion and gastronomy,” explained the studio’s design team.

    “So we imagined Her as a sinuous landscape, with impressive mountains and pure materials – all together as a new space that’s yet to be discovered, like planet Mars.”

    Clothing items are hung from wavy racks that are suspended from the ceiling. Jewellery is presented on pale circular tables supported by thin metal stems, intended to resemble “small white lotus leaves that grow from the mountains”.

    Terracotta tiles are stacked to form a series of blocky plinths that the studio likens to “reddish mountains”, where accessories can be displayed or visitors can sit and rest.

    Nestle India plans up to 3-dozen product launches in 2019, eyes higher exports

    FMCG major Nestle India has lined up nearly two-three dozen products that it plans to launch in calender year 2019 across categories in the country to drive its aggressive growth plans, Chairman and Managing Director Suresh Narayanan said.

    According to a report, the company, whose 6 percent revenues come from exports, is now looking to tap more overseas markets by targeting countries with higher Indian diaspora such as SAARC and South East Asia.

    “In 2018, our core brands have performed well…We look forward for greater acceleration as we go forward….We have two-three dozen projects (products) in pipeline for launch in 2019. These products are across categories,” Narayanan said.

    Reiterating the company’s focus on the Indian market, he said, “As an organisation the one clarion call that we are working to is that we are in the business of growth to thrive and not to survive…It is not a survival mode that we look at the opportunity in India or the opportunity for growth..but a thriving mode.”

    While the domestic market has been driving its growth, Narayanan said Nestle India would now look at expanding its export basket.

    The company is looking at tapping overseas market with higher Indian diaspora such as SAARC and South East Asia to expand its exports, he added.

    Commenting on fake news on nutrition, Narayanan said it was affecting choices and lives of people.

    Therefore, Nestle India in partnership with Google, using a chatbot mechanism, will launch a personalised information dissemination website called ‘Ask Nestle’, he added.

    “Ask Nestle seeks to be a reliable and anchor platform for nutrition and lifestyle information for customers. India is the only market where this website is being launched,” he was further said.

    When asked if the company will in future also link Ask Nestle with its own e-commerce website for selling its products, he said it is a possibility.

    “…Going forward it could morph into something bigger in terms of linking up with our own e-commerce intentions, if at all it happens. But today it is only for information sharing, dissemination and helping,” he said.

    When asked if there has been any impact on sales of Maggi noodles after Supreme Court revived government’s case in the National Consumer Disputes Redressal Commission (NCDRC) against Nestle India seeking damages of Rs 640 crore for alleged unfair trade practices, false labelling and misleading advertisements, Narayanan said “No”.

    When asked if the company is looking for manufacturing capacity expansion, he said: “…This is a question that is coming up with active consultation. That exercise is on but I can not share more at this stage”.

    Typically, our approach is to augment (capacity) at our existing factories, but it does not rule out a new manufacturing facility, Narayanan said.

    Nestle India, at present, has eight factories across the country.

    The company also did not rule out evaluating inorganic growth in the country and said it may consider it if any opportunity arises.
